OVERVIEW

Welcome to PrimeSwagPets. These Terms of Service ("Terms") govern your access to and use of the PrimeSwagPets website, online store, products, content, features, tools, and services (collectively, the "Services").

PrimeSwagPets is a brand operated by PrimePeak Global LLC ("PrimeSwagPets," "we," "us," or "our"). Our online store is powered by Shopify, which provides the technology used to operate our store and provide the Services.

By accessing, browsing, or using our Services, or by purchasing products from us, you agree to be bound by these Terms and our Privacy Policy and Return & Refund Policy. If you do not agree to these Terms, you should not access or use our Services.

SECTION 3 - ORDERS

When you place an order through our store, you are submitting an offer to purchase the products in your order.

An order is not considered accepted until we have confirmed acceptance and received or authorized payment.

We reserve the right to refuse, limit, modify, or cancel an order for reasons including, but not limited to:

  • Pricing or listing errors

  • Suspected fraud or unauthorized transactions

  • Incorrect customer information

  • Shipping restrictions

  • Suspected resale or unauthorized commercial activity

If we cancel or materially modify an order after payment has been processed, we will notify you using the contact information provided with your order and, where applicable, issue a refund for amounts charged.

Please review your order carefully before completing your purchase.

Orders may be canceled within 15 minutes of being placed, subject to our ability to process the cancellation. After that period, an order may have entered fulfillment and may no longer be eligible for cancellation.

Returns and refunds are governed by our Return & Refund Policy.

Unless otherwise agreed in writing, purchases through our store are intended for personal or household use and not for unauthorized resale or redistribution.

SECTION 5 - SHIPPING AND DELIVERY

We currently ship products to customers in the United States unless otherwise stated on the applicable product or shipping information.

Shipping and delivery dates provided by PrimeSwagPets are estimates and are not guaranteed unless expressly stated otherwise.

Delivery may be affected by circumstances outside our reasonable control, including carrier delays, weather, customs or regulatory processing, transportation disruptions, incorrect shipping information, or other unforeseen circumstances.

You are responsible for providing an accurate shipping address and other information necessary for delivery.

SECTION 6 - RETURNS AND REFUNDS

Our returns and refunds are governed by our Return & Refund Policy, which forms part of these Terms.

Unless an applicable exception applies, eligible products may be returned within 30 days after delivery.

Customers are generally responsible for return shipping costs for eligible returns unless the product is defective, damaged, or incorrectly supplied, or applicable law requires otherwise.

Products designated as Final Sale are not eligible for return or cancellation except where required by applicable law.

PrimeSwagPets and related names, logos, designs, slogans, and branding may be trademarks of PrimeSwagPets, PrimePeak Global LLC, or their respective owners.

Shopify and related trademarks belong to Shopify. Other trademarks appearing on our Services belong to their respective owners.

Our store is powered by Shopify, which provides the technology platform that allows us to operate our online store.

Your purchases are transactions between you and PrimeSwagPets/PrimePeak Global LLC. Shopify is not the seller of the products offered through our store and is not responsible for the products, fulfillment, returns, refunds, or other aspects of transactions between you and us, except as otherwise required by law or applicable Shopify terms.

To the fullest extent permitted by applicable law, PrimeSwagPets, PrimePeak Global LLC, and their respective officers, employees, contractors, service providers, affiliates, licensors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, savings, data, or business opportunities arising from or related to your use of the Services or purchase of products.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

SECTION 19 - INDEMNIFICATION

Nothing in this section limits any mandatory rights or remedies available to consumers under applicable law.
